TENTATIVE 

Plaintiff California Casualty Indemnity Exchange (“Plaintiff”) filed this subrogation action against Defendant Alfonso Alejandro Torres (“Defendant”) for property damages Plaintiff paid to its insured, Elayne Shiohama (“Shiohama”), arising from an automobile collision between Shiohama and Defendant on December 18, 2018. On November 13, 2023, Plaintiff properly dismissed all Doe Defendants. 

Plaintiff seeks damages in the principal sum of $29,021.03, in accordance with amount sought in the complaint. Plaintiff, through its custodian of records, substantiates the principal amount sought by providing proof of property damage costs and payments.   

Plaintiff further seeks costs of $531.50, comprised of clerk filing fees and process server’s fees, which are allowable under CCP §1033.5. 

Therefore, the application for default judgment filed on November 6, 2023 is GRANTED in the total amount of $29,552.53 against Defendant Alfonso Alejandro Torres.    

Plaintiff is ordered to give notice of this ruling.
