[TENTATIVE] ORDER GRANTING DEFENDANT’S UNOPPOSED MOTION TO DEEM REQUEST FOR ADMISSIONS ADMITTED

Plaintiff David Williams (“Plaintiff”) propounded request for admissions (“RFAs”), set one, on Defendant Edward Damas (“Defendant”) on December 13, 2022. To date, Defendant has not served verified responses. Plaintiff therefore seeks an order deeming the RFAs admitted and imposing sanctions.

Plaintiff’s motion to deem RFAs, set one, admitted is unopposed and granted. (CCP § 2033.280(b).)

Sanctions are mandatory. (CCP § 2033.280(c).) Plaintiff is awarded one hour for preparing the motion and one hour to appear at the hearing all at the reasonable rate of $200 per hour, for a total attorney fees award of $400. Plaintiff is also awarded the motion filing fee of $60 as costs.

Sanctions are sought and imposed against Defendant, who is in pro per. Defendant is ordered to pay sanctions to Plaintiff, by and through his attorney of record, in the total amount of $460.00, within twenty days.

Plaintiff is ordered to give notice.
