TENTATIVE 

 

Plaintiff Sheena Pahoyo Hernandez (“Plaintiff”) filed this action against defendant Shlomo Keshet and Does 1 to 50 for injuries arising from a dog bite. Plaintiff has properly dismissed all unnamed Doe defendants. 

 

Plaintiff seeks $100,000 in general damages against Shlomo Keshet. Plaintiff declares that she was bitten by a large German Shepherd on the upper left thigh while delivering a package at a residence. Plaintiff received treatment for the puncture wound and bruising, and given a tetanus shot. Plaintiff declares she is now afraid of dogs and suffers from anxiety. Plaintiff received treatment with Dr. Ashley at Ashley Psychological Center from December 29, 2021 through February 10, 2022, and declares that therapy helped manage her symptoms. In support thereof, Plaintiff provides a record of her psychological report, dated March 5, 2022, regarding the emotional impact of the incident. To date, Plaintiff attests she still has anxiety and has yet to overcome her fear of dogs.  

 

Plaintiff has supported her request for general damages, but not to the extent of $100,000. The Court therefore will reduce the amount requested accordingly.  

 

Based on the foregoing, the application for default judgment filed on February 27, 2024 is GRANTED in the principal amount of $25,000.00, against defendant Shlomo Keshet.¿ 

 

Plaintiff is ordered to give notice.
