The Court excuses the personal appearance of Claimant and the guardian ad litem. Counsel may appear by telephone or video conference call.¿
Plaintiffs have agreed to settle their claims against Defendants for the total amount of $1,000,000, with $312,500 being apportioned to Khalid Al Tamimi (“Claimant”). If the settlement is approved, $62,500 for attorneys’ fees. The net balance of $250,000 will be invested in a single-premium deferred annuity, subject to withdrawal only on authorization of the court.
Petitioner provides that settlement funds were inadvertently sent by Defendant to Plaintiff’s Counsel and deposited into Plaintiff’s Counsel IOLTA prior to obtaining an Order for Disposition of Funds to a minor. Plaintiff’s counsel avers they will return the funds to Defendant’s insurance carrier, so that the carrier will reissue the check made payable to Alexander Law Group, LLC. Upon receipt, Alexander Law Group, LLP shall forward the undeposited and unendorsed check to the Al Tamimi Qualified Settlement Fund (QSF), wherein the administrator of the QSF shall purchase a structured settlement annuity from Independent Life Insurance Company.
The Court has reviewed the settlement and finds it fair and reasonable.¿ The Court also finds the attorneys’ fees fair and reasonable, in that it amounts to 20% of Claimant’s settlement. Based on the foregoing, the petition is GRANTED.
