[TENTATIVE] ORDER CONDITIONALLY GRANTING MOTION TO BE RELIEVED AS COUNSEL

Plaintiff Michael Yedor (“Plaintiff”) attorney of record, Nicholas P. Kohan (“Counsel”), moves to be relieved as counsel, contending irreconcilable differences have arose between client and attorney making it unreasonably difficult to carry out the employment effectively.  

 

Counsel declares it served the moving papers at the Plaintiff’s last known address. Counsel declares the moving papers were served on Plaintiff via mail at Plaintiff’s last known address and that Counsel confirmed the address by text message, though Counsel did not indicate whether the confirmation of the address was within the past 30 days. Counsel has filed proof of service on Plaintiff at the last known address. No defendant has been served, and no defendant has appeared in this action. 

 

The Court wishes to hear from Counsel concerning Counsel’s efforts in confirming Plaintiff’s address by text message. Assuming the Court is satisfied with Counsel’s attempt in confirming the client’s address, the motion will be granted; the ruling is effective upon filing proof of service of the final order. The Court notes the next scheduled matter is a Final Status Conference set for January 10, 2024, and trial is scheduled for January 24, 2024. Therefore, there is sufficient time for Plaintiff to seek other counsel or otherwise prepare prior for trial. 

 

Moving Counsel is ordered to give notice.
