      CASE NO: 22STCV32014 (R/T 23STLC07359)

[TENTATIVE] ORDER DENYING MOTION TO CONSOLIDATE WITHOUT PREJUDICE

Dept. 31

1:30 p.m.

May 20, 2024

Defendant Los Angeles County Metropolitan Transportation Authority, sued as Los Angeles Metropolitan Transportation Authority, (“Defendant”) seeks an order consolidating this action 22STCV32014 with 23STLC07359, contending the two actions involve common questions of law and fact because they arise from the same incident on November 23, 2021 at the intersection of 9th Street and Maple in Los Angeles. The two cases have been deemed related and are pending in this Department. (Min. Order, April 8, 2024.)

However, the motion does not comply with California Rules of Court, 3.350, which requires a copy of the notice of motion to be filed in each case sought to be consolidated. (Cal. Rules of Court, Rule 3.350(a)(1)(C).)  The Court’s records show that the notice of motion was not filed in 23STLC07359. The denial is without prejudice to Defendant refiling the motion after complying with all Rules of Court.

Moving party is ordered to give notice.
