1. Background 

On April 5, 2018, Plaintiff Alesha Newman (“Plaintiff”) filed this action against Defendant Toni Z. Hutchinson (“Defendant”) for damages arising from a slip and fall accident.    

 

On April 5, 2023, Defendant filed this instant motion to dismiss for failure to bring this matter to trial. Since the filing of this motion, the parties informed the Court that the case has settled. (Min. Order, April 20, 2023.)   

 

 Based on the foregoing, Defendant’s motion to dismiss is moot and taken off-calendar.   

 

Defendant is ordered to give notice.
