The Court has reviewed the Petition to Approve Compromise of Pending Action of a Minor Austin Ruiz, Age 17.
Plaintiffs, Joel Reyes, Brittany Ruiz, Reynaldo Ruiz, and Austin Ruiz (“Claimant”), a minor by and through his guardian ad litem, Monica Verduzco (“Petitioner”), filed this action against Defendant City of Long Beach (“Defendant”) for damages arising from a motor vehicle accident.
Plaintiffs have agreed to settle their claims against Defendant for the total amount of $399,000,
with $349,000 being apportioned to Petitioner. If the settlement is approved, $5,600 will be used for medical expenses, $104,700 for attorneys’ fees, and $125,962.18 will be used for costs. The net balance of $112,737.82 will be deposited into a blocked account.
The court has reviewed the settlement and finds it fair and reasonable. The Court also finds the attorneys’ fees fair and reasonable, because Counsel has provided sufficient justification for 30% of the minor’s settlement in light of the efforts and time expended on this matter.
Based thereon, the Court approves and GRANTS the petition.
