OSC Re: Contempt for Failure to Pay

On July 22, 2022 the court awarded $5,261.65 in sanctions to defendant Alpine against LA Gym’s former counsel Drew Sherman. LA Gym states that as part of its settlement agreement with Alpine Equities, it was assigned the right to collect the sanctions award from Sherman. See Jungwirth declaration exhibit A pgs. 4-5 (Assignment of Rights). LA Gym states Sherman failed to pay the sanctions and moves for an order of contempt.

The court ordered sanctions to be paid to Alpine Equities, not to LA Gym. LA Gym is no longer seeking to enforce the sanctions award, but rather the parties’ settlement agreement and associated assignment of rights. LA Gym provides no authority for the proposition that sanctions awards are assignable, or that the court has authority to enforce such an assignment via a contempt order. DENIED.
