Plaintiff’s Motion to Vacate May 23, 2023 Order (UNOPPOSED)

Under Cal. Code of Civ. Proc. §473(d), a court may set aside any judgment or order that is void for improper service of process or notice.

On May 23, 2023 the court issued an order dismissing plaintiff’s complaint without prejudice for plaintiff’s failure to appear at hearings on March 21 and April 24. Plaintiff moves to set aside that order, stating she never received notice of the May 23 hearing. The motion is unopposed. In the interest of justice and a full resolution of the case on the merits, the court accepts plaintiff’s claim that notice was never received. The order will be vacated and the complaint restored as the operative pleading in this matter.
