[TENTATIVE]   ORDER CONTINUING MOTION FOR RECONSIDERATION

This matter is before the court on Respondent’s motion for reconsideration. Respondent seeks reconsideration of the court’s order of May 24, 2022 granting the petition.

On June 8, 2022, Respondent filed a motion for reconsideration.

On August 23, 2022, the court set this motion for hearing and ordered briefing on the issues raised by Respondent.

On September 6, 2022, Respondent filed a notice of appeal of the court’s May 24, 2022 order—the same order for which Respondent sought reconsideration.

Given the pending appeal, the court has no jurisdiction to entertain the motion as the motion seeks to change the court’s May 24, 2022 order.

The court is inclined to continue the motion pending resolution of Petitioner’s motion to dismiss currently pending in the court of appeal.
