TENTATIVE RULING

The Request for Entry of Default Judgment  is denied for the following reasons:

1.     Doe dismissal does not use the proper form (CIV-110).

2.     The medical bills attached as exhibits to the summary of the case include repeat charges, so it is difficult to itemize the charges to determine if they match the amounts stated in the summary. Plaintiff requests damages for $31,603.40 in medical bills.

3.     Plaintiff requests damages for pain and suffering in the amount of $63,206.80, which is unsupported by evidence.

The Court sets a hearing on an Order to Show Cause why the case should not be dismissed and/or Plaintiff’s counsel sanctioned $250 for failing to enter default judgement (CRC 3.100(h)) on June 12, 2023, at 8:30 AM in Department 71 at Stanley Mosk Courthouse.
