TENTATIVE RULING

Defendants JV General Construction Inc.’s and Jaime Villalvazo’s demurrer and motion to strike are continued to October 14, 2022.

Defendants filed the instant demurrer on March 22, 2022. Plaintiff’s opposition to the demurrer was untimely filed and served pursuant to C.C.P. §1005(b).  Plaintiff’s 0pposition was due September 15, 2022, nine court days before this hearing. Plaintiff’s opposition was filed September 19, 2022.  Defendants filed their reply on September 21, 2022. 

Defendants also filed their motion to strike on March 22, 2022. Apparently, Plaintiff filed an opposition to the motion to strike as a late opposition is referred to in Defendants’ reply, filed on September 21, 2022.  However, the opposition to the motion to strike was not filed with the Court.  Accordingly, Plaintiff is ordered to file the opposition within 24 hours.  The motion to strike is continued to October 14, 2022 at 9:30 a.m.
