 Hearing Date:  February 14, 2023

 

Specially Appearing Defendants Doe #3’s and Diet Madison Avenue’s motion to quash Plaintiff Ralph M. Watson’s subpoena to GoFundMe, Inc., is continued to March 20, 2023, at 8:30 a.m.

 

Specially Appearing Defendants are directed to refile their motion arguing and citing to law applicable to this Court in accordance with the California Rules of Court by February 28, 2023.  Plaintiff is to file an opposition by March 14, 2023.

 

Specially Appearing Defendants Doe #3 (“Doe #3) and Diet Madison Avenue (“DMA”) (collectively, “Defendants”) move for an order quashing the Deposition Subpoena (“Subpoena”) served by Plaintiff Ralph M. Watson (“Watson”) (“Plaintiff”) on GoFundMe, Inc. (“GoFundMe”).  (Notice of Motion, pg. 2; C.C.P. §1987.1.) 

 

C.R.C. Violations

 

          Specially Appearing Defendants are admonished for failing to offer any briefing as to the substantive argument that the subpoena is improper under the laws of this jurisdiction and citing to over 80 pages of briefing referring mostly to federal authorities that they “incorporate by reference.”  (C.R.C., Rule 3.1113(b).)  Further, Specially Appearing defendants cited to an unpublished opinion in violation of C.R.C., Rule 8.1115.

 

          Specially Appearing Defendants are directed to refile their motion in accordance with the California Rules of Court by February 24, 2023.  Plaintiff may file its supplemental opposition by March 7, 2023 and Specially Appearing defendants may file a supplemental reply by March 14, 2023.

 

Based on the foregoing, Specially Appearing Defendants’ motion to quash is continued to March 20, 2023, at 8:30 a.m.
