Judge: Nathan R. Scott, Case: Alvarez v. Abi-Najm, Date: 2022-09-09 Tentative Ruling
Defendant Johnny Tannous Abi-Najm’s motion for discovery sanctions is granted in part.
Plaintiff Sheila Alvarez shall revise her amended supplemental responses to defendant’s request for production of documents (see 8/29/22 Benice decl. Ex. A) to:
· omit all objections (all objections were overruled on 4/15/22)
· specify with reasonable particularity which documents were produced in response to Requests #21-22, 30-31, 62-66, 70-79, 84-85, 96-107, 114-116, & 118-125. (the initial response says no responsive document exist; the amended response says all responsive documents were produced)
· specify with reasonable particularity which documents were produced in response to 17-20, 23-29, 34-35, 81, & 117 (the amended response say responsive documents will be produced; defendant denies receiving them; all the court has is a printout of an email with a Dropbox link)
Plaintiff shall serve her revised responses no later than 9/29/22. The parties shall file supplemental briefs on compliance with this order no later than 10/14/22. The parties may file responses to the supplemental briefs no later than 10/27/22.
This hearing will be continued to 11/4/22 at 10 am to determine whether to impose any additional sanctions requested in the motion.
Plaintiff shall pay $3270 in discovery sanctions to defendant.
Defendant shall give notice.
