Judge: Nathan R. Scott, Case: Dina Marciano Design v. Kaz Investments Management, Date: 2022-09-09 Tentative Ruling

Plaintiff Dina Marciano Design’s seven motions to compel are granted.

Defendant Shady K. Elzoheiry shall serve complete, code-compliant, verified responses without objection to plaintiff’s form interrogatories (set one), special interrogatories (set one), and requests for production of documents (set one) within 20 days, and produce all responsive documents within 30 days.

Defendant KAZ Investment Management shall serve complete, code-compliant, verified responses without objection to plaintiff’s form interrogatories (set one), special interrogatories (set one), requests for admission (set one), and requests for production of documents (set one) within 20 days, and produce all responsive documents within 30 days.

Plaintiff’s sanctions request is denied.  There was some confusion about a possible settlement.  (See Ward decls. ¶¶ 3-4 & Exs. 1-2.)  While that does not relieve defendants of the duty to respond to the pending discovery, it does make the imposition of sanctions unjust. 

Plaintiff shall give notice.
