Judge: Nathan R. Scott, Case: Kort vs. Lee, Date: 2022-10-07 Tentative Ruling

Cross-complainant Jason Lee’s motion to compel is denied.

Lee shall pay $4200 in discovery sanctions to cross-defendant Ron Kort within thirty days.

As the opposition notes, Lee failed to meet and confer over the 9/18/22 supplemental responses.

Moreover, the opposition substantiates Kort’s relevance objection.  Lee seeks information regarding 19-year-old litigation against Kort with no showing of how that information could affect the evaluation, preparation, or settlement of this case.  (See (Lopez v. Watchtower Bible & Tract Society of New York, Inc. (2016) 246 Cal.App.4th 566, 591.)  While “fishing expeditions are permissible in some cases” (ibid., cleaned up), this one is too far afield.

Lee shall give notice.
