Status Conference

The court thanks the parties for their briefs on bifurcating the dissolution cause of action.  It looks forward to hearing additional argument on this issue.

 

Motion to Compel

Plaintiff Richard Kossler’s motion to compel defendant is denied as moot, except as to sanctions.  (See Sinaiko Healthcare Consulting, Inc. v. Pacific Healthcare Consultants (2007) 148 Cal.App.4th 390, 409; see also Reply at pp. 2-3 [late responses received].)

 

Defendant Arash Durrani and former defense counsel

Edlin Gallagher Huie + Blum shall jointly and severally pay $2570 to plaintiff.  (See Code Civ. Proc., §§ 2031.310, subd. (h), 2033.280, subd. (d).) 

 

The court declines to impose an additional $250 in sanctions for failing to meet and confer.  (See Code Civ. Proc., § 2023.020.)  Former defense counsel did meet and confer in good faith, but defendant’s position lacked substantial justification.

 

Plaintiff shall give notice to defendant and former defense counsel.
