Motion to Strike

Defendants Uriel Mora and Estella Clorissa Gonzalez’s motion to strike is granted.

Plaintiff Eladio Mora shall have leave to separately e-file the proposed first amended complaint (attached as exhibit A to her counsel’s declaration) within 5 days, which shall be deemed served upon filing.

Separate e-filing is critical to ensure the FAC is properly indexed in the court’s electronic filing system.

The parties agree the complaint’s procedural defects “can be easily cured.”  (See Opp. at p. 2; see also Reply at p. 1.)

Defendants shall give notice.
