Judge: Nathan R. Scott, Case: Nguyen v. City of Anaheim, Date: 2022-09-30 Tentative Ruling
Defendant City of Anaheim’s motion to bifurcate is granted.
Defendant has shown it would promote the economical and efficient handling of the litigation to try the Heck defense to the service animal allegations first, in a bifurcated bench trial. (See Code Civ. Proc. §§ 598, 1048(b); Fetters v. County of Los Angeles (2016) 243 Cal.4pp.4th 825, 834-835; see also 8/19/22 order [discussing Heck defense].)
Defendants shall give notice.
