Judge: Nathan R. Scott, Case: Shops at Mission Viejo v. Hasan Group, Date: 2022-12-09 Tentative Ruling
Case Management Conference
The CMC is continued to 2/9/23 at 2 pm.
Motions to quash service
Defendant Shahana Hasan’s and Zia Hasan’s motions to quash service of summons are denied.
Defendants shall file and serve responses to the complaint within 10 days.
As defendants reside in South Carolina, service may be made “by sending a copy of the summons and of the complaint to the person to be served by first-class mail, postage prepaid, requiring a return receipt.” (Code Civ. Proc., § 415.40.)
“This is the most liberal method for service of summons allowed under California law. A nonresident can be served anywhere in the world simply by mailing him or her copies of the summons and complaint . . . .” (Weil & Brown, Cal. Practice Guide: Civ. Procedure Before Trial (The Rutter Group 2022) ¶ 4:293.)
Plaintiff showed it complied with the mailing requirement. (See Herzog decl. ¶¶ 4-7 & Exs. A-C.)
The clerk shall give notice.
