Motion to Compel Compliance with Request for Production of Documents

The parties are ORDERED to present forthwith to Judge Kirk Nakamura (Ret.) Plaintiff Smartstop Asset Management LLC’s motion to compel Defendant Tripemco Burlington Insurance Group Limited to comply with Defendant’s agreement to produce documents in response to Plaintiff’s request for production of documents (set one) and request for sanctions.

Plaintiff Smartstop Asset Management LLC moves to compel Defendant Tripemco Burlington Insurance Group Limited to comply with Defendant’s agreement to produce documents in response to Plaintiff’s request for production of documents (set one). Plaintiff also requests the court to impose monetary sanctions in the amount of $2,397.50.

On 10/26/2022, the court entered the Order Granting Ex Parte Application to Appoint Honorable Kirk Nakamura (Ret.) Discovery Referee Pursuant to C.C.P. 639(a)(5). (ROA #387.) Pursuant to that order, Judge Nakamura has the power to rule on all discovery motions and disputes. Accordingly, the court declines to issue a ruling on the instant motion at this time. The parties shall present this discovery dispute to Judge Nakamura for his ruling and recommendation.

Plaintiff shall give notice of this ruling.
