Motion for Attorney Fees

Defendants G&R Precision Grinding, Inc., Ronald Graves, and Terry Graves’ motion for attorney fees is GRANTED.  (Code Civ. Proc., §§ 1032, subd. (b) [prevailing party entitled to costs], 1033.5. subd. (a)(10)(A) [recoverable costs include attorney fees pursuant to contract]; Civ. Code, § 1717 [governing contractual attorney fees]; Trial Ex. 1, ¶7, subd. (g).) 

On its own motion, the court takes judicial notice of plaintiff’s original Complaint (ROA 2) and First Amended Complaint (ROA 24), as well as the parties Joint Exhibit List (ROA 93), which includes a copy of the Settlement Agreement which was the subject of this action as Exhibit 1.  Defendants are awarded attorney fees in the amount of $26,900.50, which amounts the court finds were reasonably and necessarily incurred.

Moving parties shall give notice.
