Motion to Compel Further Responses to Special Interrogatories

Plaintiff Associated Ready Mix Concrete, Inc.’s motion to compel defendant Lewis Pedigo dba 24/7 Concrete Pumping to provide responses to Special Interrogatories, Set One, and to pay sanctions, is GRANTED in part and DENIED in part.  (Code Civ. Proc., § 2030.290 [authorizing motion]; Appleton v. Superior Court (1988) 206 Cal.App.3d 632, 635 [unverified responses are the equivalent of no responses at all].)

Defendant Lewis Pedigo dba 24/7 Concrete Pumping shall provide full, complete, and verified responses to plaintiff’s Special Interrogatories, Set One, without objection, within 15 days.

Plaintiff’s sanctions request is DENIED.  Plaintiff’s notice of motion does not comply with Code Civ. Proc., § 2023.040 [“A request for a sanction shall, in the notice of motion, identify every person, party, and attorney against whom the sanction is sought, and specify the type of sanction sought”].)

Moving party shall give notice.
