Plaintiff Balboa Capital Corporation’s motion for summary adjudication as to the first, third and fourth causes of action is GRANTED as against Daniel Reyes-Villa MD, a sole proprietorship and defendant Daniel Reyes-Villa, an individual.  

Plaintiff has met its initial burden showing the first, third and fourth causes of action against the Responding Party defendants are valid.  As there is no opposition, Responding Party defendants have not met their now shifted burden in raising a triable issue of fact thereto.
