Motion for Leave to File Amended Complaint
Plaintiffs’ Motion for Leave to File Amended Complaint is DENIED. (See Code Civ. Proc. §473.)
A renewed motion for the same relief must be supported by a declaration stating:
(i) what motion or application was previously made; (Established by counsel’s declaration)
(ii) when it was made; (Established by counsel’s declaration)
(iii) the judge before whom it was made; (Not established)
(iv) what order or decision was then made; (Established by counsel’s declaration)
and
(v) what new or different facts, circumstances or law are claimed to exist. (Not established by counsel’s declaration)
(See Code Civ. Proc. § 1008, subd (b).) If the statutory requirements above are not met, the renewal motion must be denied. If for any reason an order granting relief is made, that order may be revoked on ex parte application. (Id.)
Plaintiff’s motion fails to comply with the requirements for a renewed motion pursuant to Calif. Code of Civil Procedure, section 1008, subdivision (b), thus the motion is denied
Moving party to give notice.
