T&R Carnegie 1 Properties, LLC and Marvin Ralph Solomon and Trevalene Lugene Solomon, as Trustees of the Marvin Ralph Solomon, Trevalene Lugene Solomon Trust dated August 26, 1998, demurrer to the 3rd cause of action of the complaint of plaintiff John Bartolo and Bartolo Window Treatment Designs, Inc. is SUSTAINED with 15 days leave to amend. 

Plaintiff hasn’t set forth sufficient facts showing Moving Party defendants’ owed plaintiff a duty to disclose the alleged “dangerous” activities engaged in by co-defendant Engravers.

Motions to Strike:

To the extent the motions to strike filed by the T&R Carnegie defendants and Millennium Community Management, LLC, are not moot, they are GRANTED.
