Defendants Los Alamitos Racing Association, Los Alamitos Harness Racing Association, and Dr. Edward C. Allred’s motion to stay this action is DENIED without prejudice. 

If, and when, there is a factual determination that Allred was plaintiff’s employer for purposes of the injuries plaintiff received while riding Allred’s horse, Moving Parties may again address the issue of a stay. 

Moving Parties’ request for judicial notice is granted as to the documents themselves, but not as to the truth of the matters asserted therein.

Moving Parties’ objections to evidence cited in opposition to this motion are overruled as to #4 and sustained as to the remainder. 

Case Management Conference is continued to February 3, 2023 at 9:30 AM to coincide with Demurrer to Amended Complaint.

Plaintiff to give notice of all the above.
