Motion to Enforce Settlement

Plaintiff HG Newport Owner LLC motion to enforce settlement is GRANTED. (See Code Civ. Proc., § 664.6.)

The court ORDERS judgment entered in the amount of $159,565.87 in favor of plaintiff HG Newport Owner LLC (plaintiff), and against defendant MacArthur Court Acquisition Corp. (defendant), pursuant to the terms of the settlement agreement. (See Lavery Decl. ¶¶ 2-8, Ex. A [settlement agreement].)  

Attorney fees and costs in the total amount of $5,800 are GRANTED in favor of plaintiff and against defendant. (See Lavery Decl. at Ex. A [settlement agreement § 21].)

Plaintiff is ORDERED to file a proposed judgment reflecting the above, within 10 days of the date of this hearing.

Plaintiff shall give notice.
