Defendant USAA Casualty Insurance Company’s demurrer to complaint is SUSTAINED in its entirety on the ground of uncertainty, with ten days leave to amend. (See Code Civ. Proc., § 430.10, subd. (f).)

 

Plaintiff June P. Simpson may serve and file a first amended complaint within ten days.

 

The current complaint is fatally uncertain. The complaint is so uncertain that it is impossible to ascertain what conduct is at issue, or the theory of liability that plaintiff may be attempting to assert. The complaint must state facts that show a basis for liability against the defendant, but as it presently stands, the basis for liability remains a mystery. Defendant is entitled to know why and on what grounds it is being sued.

 

Defendant shall give notice.
