Judge: Nick A. Dourbetas, Case: 2022-01277792, Date: 2023-08-18 Tentative Ruling

1. Motion to Compel Production
2. Case Management Conference

Petitioner Fortis, LLP’s Continued Motion to Compel Further Responses to Inspection Demands is GRANTED in part.

In addition to the Court’s previous ruling, the Court orders respondent Frances Marquez to produce all four records set forth in her privilege log within 7 days.

The privilege log does not raise any privileges such as attorney-client or work product, just objections on the merits. To the extent that the log raises claims that the records should not be released based upon Government Code, section 7922.000, the privilege log fails to provide sufficient information for the court to determine whether the public interest served by not disclosing the record clearly outweighs the public interest served by disclosure of the record.

As sanctions were not noticed as required by Calif. Code of Civil Procedure, section 2023.040, all request for sanctions are DENIED.
