Defendant Placentia-Linda Hospital’s demurrer to the First Amended Complaint, and motion to strike portions of the First Amended Complaint, are CONTINUED to January 12, 2024 at 9:30 AM.

Moving party has not satisfied the meet and confer requirements for both motions.  (Code Civ. Proc., §§ 430.41, subd. (a), and 435.5, subd. (a).)  Moving party did not meet and confer regarding the amended pleading, as required; further, the meet and confer discussions regarding the original Complaint took place by email, while the applicable statutes require discussions occur in person or by telephone.  (Id.; Flagg Decl. in support of respective motions, ¶¶ 3-5.)

The Court orders the parties to engage in Code-compliant meet and confer efforts, and orders counsel for moving party to file a supplemental declaration demonstrating such compliance at least 7 court days prior to the hearing.
