Defendants Healthcare Services, Inc.’s, Windstone Addiction Centers, Inc.’s, Timothy Salyer’s, and Zouana Lindsey’s Motion to Compel Deposition is DENIED.

 

Defendants fail to establish that they properly noticed the third session of plaintiff’s 01/27/23 deposition, especially in light of plaintiff’s counsel’s withdrawal of the agreement to produce plaintiff on that date. (See Zimmerman Dec. Exh. K.)

 

Defendants’ request for sanctions is denied.

 

 

Motion No. 2

 

Defendants Healthcare Services, Inc.’s, Windstone Addiction Centers, Inc.’s, Timothy Salyer’s, and Zouana Lindsey’s Motion to Compel Plaintiff to Serve Further Responses and All Responsive Records to Defendants’ Inspection Demands, Set No. 2, and Imposition of Monetary Sanctions is GRANTED in part. (See Code Civ. Proc. § 2031.310.)

 

Plaintiff Cara Castillo is ordered to serve verified, complete, and non-evasive responses to defendants’ inspection demands, Set no. 2 within 20 days, along with all responsive records.

 

The Court imposes $2,100.00 in monetary sanctions against plaintiff Cara Castillo, payable to counsel for defendant within thirty (30) days.

 

Defendants are ordered to give notice of all the above.
