Motion to Compel Further Responses to Special Interrogatories
Plaintiff Fabian Villalobos’ motion to compel defendant FCA US LLC to provide further responses to Special Interrogatories, Set One, is GRANTED in part and DENIED in part. (Code Civ. Proc., § 2030.300 [authorizing motion].)
Special Interrogatory Nos. 1, 2, 4-6, 22, 23, 30, 31, 33: Grant. Defendant shall provide full, complete, and verified further responses, without objection, within 15 days. If defendant exercises its option to produce documents, its further response shall comply with Code Civ. Proc., § 2030.230 [specification of responsive documents “shall be in sufficient detail to permit the propounding party to locate and to identify, as readily as the responding party can, the documents from which the answer may be ascertained”].)
Special Interrogatory Nos. 21, 24: Grant in part. Defendant shall provide full, complete, and verified further responses, without objection, limited to the time period of 1-1-2021 to present. If defendant exercises its option to produce documents, its further response shall comply with Code Civ. Proc., § 2030.230.
Special Interrogatory Nos. 3, 37-42: Withdrawn per moving party’s Reply.
All further responses shall be produced to the offices of counsel for moving party within 20 days.
Monetary sanctions are imposed against defendant FCA US LLC and its attorney of record Erin Hanson, jointly and severally, in the amount of $2,663.50. Sanctions are payable to counsel for moving party within 30 days.
Plaintiff shall give notice.
