Motion 1:

Plaintiff’s Motion to Compel Defendant Dr. Joseph Anthony Murphy to Serve Verified Responses Without Objections to Plaintiff’s Form Interrogatories, Set No. 1, and Imposition of Monetary Sanctions is DENIED AS MOOT in part, and GRANTED in part. (See Code Civ. Proc. § 2030.290).  

Motion 2:

Plaintiff’s Motion to Compel Defendant Dr. Joseph Anthony Murphy to Serve Verified Responses Without Objections to Plaintiff’s Special Interrogatories, Set No. 1, and Imposition of Monetary Sanctions is DENIED AS MOOT in part, and GRANTED in part. (See Code Civ. Proc. § 2030.290). 

The motions for verified responses are denied as moot based upon the service of verified responses to the interrogatories without objections on 04/11/23. (See Benice Dec. ¶¶ 2 & 3, Exh. A & B.)

The Court ordinarily does not consider untimely supplemental declarations (Benice Suppl. Dec.), however has done so here.  Accordingly, the Court imposes monetary sanctions against defendant Dr. Joseph Anthony Murphy in the sum of $750 per motion, for a total sanctions award of $1,500. All sanctions payable to plaintiff’s counsel within 30 days.
