Petitioner Alex Vanderhorst's demurrer is CONTINUED to a date agreeable to the parties.

Petitioner filed a demurrer to the 'Complaint in Intersession to Enforce State Documents of Decedent Lony Vanderhorst Pursuant to Code of Civil Procedure § 387' filed on April 24, 2023, by the proposed intervenor, Deborah Vanderhorst Casaburi ('Deborah') at ROA 149. (ROA 163, Notice of Demurrer.) Subsequently, on September 14, 2023, Deborah filed a 'Petition for Leave to Intervene and to Allow Complaint in Intersession to Enforce Estate Documents of Decedent Lony Vanderhorst with Proposed Complaint Included Pursuant to California Code of Civil Procedure § 387.' (ROA 179.) This petition, which the Court deems a motion to intervene, is currently set for a hearing on December 5, 2023. (ROA 180.) As such, the Court will not rule on the demurrer until the motion to intervene is heard first. Thus, the demurrer is CONTINUED to a date agreeable to all parties, after the hearing on the motion to intervene is heard on December 5, 2023.
