TENTATIVE RULING

Defendants Knights Inn – Pico Rivera, Lin, and Lin & Sons Investments, Inc.’s motion to continue trial is GRANTED.

Moving Parties to give NOTICE.

Defendants Knights Inn – Pico Rivera, Lin, and Lin & Sons Investments, Inc. move to continue trial pursuant to CRC Rule 3.1332(c)(6).

“Although continuances of trials are disfavored, each request for a continuance must be considered on its own merits. The court may grant a continuance only on an affirmative showing of good cause requiring the continuance. Circumstances that may indicate good cause include… (6) A party's excused inability to obtain essential testimony, documents, or other material evidence despite diligent efforts.”  (CRC Rule 3.1332(c)(6).)

Defendants are seeking a continuance to conduct necessary discovery.  (LaScola Decl., ¶¶ 5-8.)  Additionally, Plaintiffs do not oppose the motion, and have executed a stipulation to continue trial, including all pre-trial cut-off dates.  (Id., Ex. A.)

Accordingly, the motion is GRANTED.  Trial is continued to 11/21/2023 or to a later date of counsels’ choosing and available to the Court, 9:30 a.m. in Dept. F.  The FSC is continued to     11/7/2023              at  9:30 a.m. in Dept. F.  All pre-trial cut-off dates will correspond with the new trial date.
