Eric Cleveland vs Fan Shin Investment, LLC, Case No. 21NWCV00421

This lawsuit alleges violations of the American with Disabilities Act and the Unruh Civil Rights Act.  Plaintiff Eric Cleveland (“Plaintiff”) applies ex parte for an order shortening time for notice and hearing on his Motion to Continue Trial.

Plaintiff contends there are numerous discovery issues pending, including scheduling the depositions of Defendant PB’s PMK, Gonzalo Ponce, and Alfredo Ponce, all of which were compelled by Judge Lee Tsao on May 15, 2024.  Plaintiff’s Motion to Continue Trial is currently scheduled for June 12, 2024,.  Trial is currently set for June 26, 2024.

Plaintiff’s Ex Parte application is DENIED.  In the alternative, Plaintiff’s Motion to Continue Trial is ADVANCED to this date and GRANTED.  Trial is continued to September 12, 2024 at 9:30 a.m. in Dept. SE-F.  Final Status Conference is scheduled for August 29, 2024 at 9:30 a.m. in Dept. SE-F.  All pretrial discovery and motion deadlines are extended in compliance with the new trial date.  The previously scheduled dates for Trial, Final Status Conference, and Motion to Continue Trial are VACATED.
