TENTATIVE RULING

 

Petitioner Swift Financial, LLC’s petition to confirm arbitration award is GRANTED.  Judgment is entered in conformity with the award.

 

Moving Party to give NOTICE.

  

Petitioner Swift Financial, LLC moves to enforce an arbitration award.

 

Any party to an arbitration award may petition the court to confirm, correct, or vacate an arbitration award. (CCP § 1285.) A response to the petition may request the court to dismiss the petition, confirm, correct or vacate the award. (CCP § 1285.2.)  The petition must contain the following: 1) the substance of or have attached a copy of the agreement to arbitrate; 2) the names of the arbitrators; and 3) a copy of the award and written opinion of the arbitrators, if any. (CCP § 1285.4.) If a petition is duly served and filed, the court shall confirm the award as made. (CCP § 1286.) If an award is confirmed, judgment shall be entered in conformity therewith. The judgment so entered has the same force and effect as, and is subject to all the provisions of law relating to, a judgment in a civil action of the same jurisdictional classification; and it may be enforced like any other judgment of the court in which it is entered, in an action of the same jurisdictional classification. (CCP § 1287.4.)

 

On October 23, 2019, the parties entered into a written agreement, containing an arbitration clause.   (Petition, Exhibits.)

 

The arbitration award was made on February 4, 2022, requiring respondent to pay Petitioner the sum of $87,886.04.  There is no opposition.

 

The motion is GRANTED. Judgment is entered in conformity with the award.
