TENTATIVE ORDER

The Hearing for Order on Disbursement of Surplus Proceeds of Trustee’s Sale is CONTINUED to Wednesday, December 21, 2022 at 1:30 p.m. in Dept. SE-C.

 As of December 6, 2022, the Court is in receipt of one claim submitted by Claimant Noel L. Vaughan, Jr. Trustee of the Noel L. Vaughan, Jr. Trust UDT DTD 12/12/2015 (“Vaughan”). In his claim, Vaughan seeks: (1) sums expended and incurred through July 31, 2022 of $14,084.50; (2) a non-disclosed supplemental claim amount to be filed for fees incurred since July 31, 2022; and (3) an order from the Court to hold an additional $40,000.00 “because the case remains pending and fees continue to be expended, and it will be so until the fee exposure and collateral advance are fixed by either release of all borrower claims or dismissal of their claims with prejudice.” (Vaughan Claim 7:24-8:2.)

As indicated above, only one claim has been submitted as of December 6, 2022. To date, the Court has not received any supplemental declaration/claim from Vaughan. In the interests of judicial efficiency, this matter is CONTINUED as indicated above, and Vaughan is ORDERED to file and serve a “Supplemental Claim” on or before December 16, 2022 that accounts for the full claim amount that he is seeking.
