TENTATIVE RULING

Defendant Thomas’s motion to transfer case (change of venue) is DENIED.

Opposing Party to give NOTICE.

Defendant Thomas moves to transfer this action to pursuant to CCP § 396b. 

“Upon the hearing of the motion [to change venue] the court shall, if it appears that the action or proceeding was not commenced in the proper court, order the action or proceeding transferred to the proper court.” (CCP § 396b(a).)

Defendant Thomas declares that she currently resides in the County of Los Angeles; the claim arose in the County of Los Angeles; and the real property is located in the County of Los Angeles.  (Thomas Decl., filed on September 6, 2022.)

The court finds that this action was filed in the correct jurisdiction, which is the Superior Court of California, County of Los Angeles.

Accordingly, motion is DENIED.
