Plaintiff moves for mandatory trial preference under CCP §36(a).

CCP §36(c)(1) states, “A party may file and serve a motion for preference supported by a declaration of the moving party that all essential parties have been served with process or have appeared.” (Id.)

The Court has reviewed Plaintiffs’ Moving Papers, and there is no declaration attached indicating that all essential parties have been served with process or appeared. Upon the Court’s review of this case file, the following parties have not yet been served with process or appeared in this action: SOCA CONTRACTORS CORPORATION; and GOLCHEH DEVELOPMENTS AND INVESTMENTS, LLC.

Plaintiff’s  motion is denied without prejudice.
