Background   

 

This is an unlawful detainer action regarding the commercial premises located at 1655-G S. Azusa Avenue in Hacienda Heights, CA (“subject premises”).

 

On March 15, 2022, Plaintiffs Pacific Castle Colima I LLC and Master K Investments I, LLC filed a complaint, asserting a cause of action against Yu-Shuao Chang dba The Old Boys (“Chang”) and Does 1-10 for:

 

  1. Unlawful Detainer

 

On April 19, 2022, Chang’s and All Other Occupants in Possession’s defaults were entered.

 

A Case Management Conference is set for July 27, 2022.

 

Discussion

 

Plaintiff’s Application for Default Judgment is denied without prejudice. The following defects are noted:

 

Judi Harris (“Harris”), the director of property management for the subject premises, attests that Chang was evicted from the subject premises on May 19, 2022. (Harris Decl., ¶ 6.) Harris’s declaration is likewise dated May 19, 2022. Harris further attests that “[d]efendant’s security deposit will be applied in accordance with the Lease and California law once Plaintiff has a chance to fully inspect the Premises for damage beyond ordinary wear and tear.” (Id.)

 

Plaintiff is requested to provide the court with a supplemental declaration from Harris or any other authorized representative on its behalf addressing application of the security deposit.
