Background   

Plaintiff Pinnacle Bank (“Plaintiff”) alleges as follows: On or about February 14, 2020, Defendant Oscar G. Estrada (“Defendant”) executed and delivered to Plaintiff an unsecured promissory note (“Note”), wherein Defendant agreed to make payments to Plaintiff over an 84-month term. Defendant has failed to make the required scheduled payments.

On May 3, 2022, Plaintiff filed a complaint, asserting a cause of action against Defendant for:

1.                  Breach of Promissory Note

On July 22, 2022, Defendant’s default was entered.

A Case Management Conference and Order to Show Cause Re: Failure to File Proof of Service are set for September 12, 2022.

Discussion

Plaintiff’s Application for Default Judgment is granted; however, attorney’s fees are reduced from $2,197.47 to $1,357.56 pursuant to Local Rule 3.214 (i.e., $690.00 + 3% of $22,252.12). Plaintiff is ordered to submit a revised Proposed Judgment.
