Background   

Plaintiff DHL Express (USA), Inc. (“Plaintiff”) alleges as follows: On May 3, 2021, Plaintiff and Defendant RNP Global Inc. (“Defendant”) entered into a written agreement whereby Plaintiff agreed to provide shipping to Defendant in exchange for payment. Defendant has failed to make payment.

On June 9, 2022, Plaintiff filed a complaint, asserting causes of action against Defendant and Does 1-10 for:

2.                  Common Counts

On August 16, 2022, Defendant’s default was entered.

An Order to Show Cause Re: Default Judgment is set for January 18, 2023.

Discussion

Plaintiff’s Application for Default Judgment is denied without prejudice. The following defects are noted:

Plaintiff has failed to dismiss Doe Defendants.
