The unopposed Motion for Approval of $490,000 PAGA Settlement is GRANTED subject to the following:

$10,000.00 total for Plaintiffs’ enhancement ($5,000 to each);

$163,333.33 for attorney fees to be allocated between Capstone Law APC and the Law Office of China R. Rosas in accordance with their agreement;

$12,640.23 total for litigation costs to be allocated;

$8,044.92 to Capstone Law APC and $4,595.41 to the Law Office of China R. Rosas [reduced for postage, copies, faxing, messenger fees]; and

$10,950.00 for settlement administrator fees and costs; and

$293,076.44 total for PAGA penalties with $219,807.33 to the LWDA (75%) and $73,269.11 to the aggrieved employees (25%).

Plaintiff is ordered to submit a revised Notice in accordance with the above and with the following within 5 court days:

1.    The Notice should advise aggrieved employees of the claims that are released;

2.    The Notice should include the Net Settlement, and the portions allocated to the LWDA and to the aggrieved employees; and

3.    The Notice should include a definition of aggrieved employees.

Plaintiff is ordered to give notice, including to the LWDA, and file a proof of service.
