Having considered the papers, including all supplemental papers, filed in connection with the Motion for Approval of $299,999.00 PAGA Settlement, the parties should be ready to address the following issues at the hearing hereon.

1.    Although an Amendment to the Settlement has been proposed, the copy received by the Court is not signed by the Defendant. A fully executed Amendment must be filed with the Court.

2.    It does not appear that the LWDA was served with the supplemental papers?

3.    The proposed Order should be revised so that the dismissal will be entered after the final accounting hearing.

If these issues are resolved at the hearing, the Court is inclined to GRANT the Motion subject to the following: 

$ 5,000.00 for Plaintiff’s enhancement payment;

$ 99,999.66 for attorney’s fees;

$ 14,542.04 for litigation costs;

$ 8,850.00 for the Settlement Administrator’s Fees and Costs; and

$ 171,607.30 total PAGA penalties with $128,705.48 allocated to the LWDA (75%) and $42,901.82 allocated to the aggrieved employees.

Plaintiff is ordered to submit the revised proposed Order within 5 court days.

Plaintiff is ordered to give notice, including to the LWDA, and file a proof of service.
