Plaintiff Blake Mitchener’s unopposed Motion for Leave to File Second Amended Complaint is GRANTED.

Plaintiff seeks to file a Second Amended Complaint to add Barbod Mohebi, the CEO, Secretary and CFO of Defendant Clear Start Today, as an individual defendant, as allegedly subject to liability under Labor Code § 558.1.  Jingozian Decl., ¶¶14-15. There is no prejudice to Defendants since there is no trial date set and the case is still in its early stages.

Plaintiff has complied with CRC Rule 3.1324.

Additionally, as noted, there is no opposition to this Motion.

The Second Amended Complaint must be filed within 5 court days, and served as soon as reasonably possible, with proof of service filed with the court.

The status conference is continued to November 4, 2022 at 9:00 a.m. and all parties then appearing in the action are Ordered to file a joint status report not later than October 28, 2022.

Plaintiff is ordered to give notice.
