Judge: Peter Wilson, Case: 2020-01153124, Date: 2022-09-29 Tentative Ruling

Having reviewed the moving papers filed in connection with the Motion for Final Approval, the Court will GRANT the Motion subject to the following:

1.    Plaintiffs’ enhancements: $2,500 to each of the four named Plaintiffs;

2.    Attorney fees: $83,325;

3.    Attorney costs: $10,000;

4.    Class Administrator fees: $12,000;

5.    PAGA penalties $25,000 ($18,750 to LWDA and $6,250 to Aggrieved Employees).

Plaintiffs are to file a revised [Proposed] Final Approval Order and Judgment within 5 court days consistent with the above and the following revisions:

       1.  Identify the settlement by ROA number. (¶ 1 n.1.)

       2.  Include a class definition (¶ 4), which explicitly defines the “Settlement Period”:  All current and former hourly and/or non-exempt persons employed by Defendants in California from 07-29-2016 to 04-01-2022.

        3.  Delete ¶¶ 19, 21, and the final sentence of ¶ 23.

        4.  Propose an actual date for the Final Accounting (¶ 25), which the Court hears on Thursdays at 2:00 p.m.

Plaintiffs are ordered to give notice, including to the LWDA, and file a proof of service within 5 court days.
