Having considered the papers, including all supplemental papers, filed in connection with the Motion for Final Approval of $1,250,000.00 Class and PAGA Action Settlement, the parties should be prepared to address the following issue:
1. The Redlined Proposed Order attached as Exhibit 5 to the ROA 165, Supp. Melmed Decl. and the filed proposed Order (ROA 168) did not include the names of the individuals who opted out in paragraph 7 or a statement that there was only one workweek dispute.
If these issues are resolved at the hearing, the Court will GRANT the Motion subject to the following:
$ 15,000.00 total ($7,500.00 each) for Plaintiffs’ Enhancement;
$ 416,666.67 total for attorney’s fees to be allocated 50/50 between Melmed Law Group, P.C. and Employment Lawyers;
$ 13,668.12 total for litigation costs to be allocated as follows: $7,893.50 [reduced $16.32 for postage (Code Civ. Proc. § 1033.5(b)(3)] to Melmed Law Group, P.C. and $5,774.62 to Employment Lawyers;
$ 10,500.00 for Settlement Administrator’s Fees and Costs; and
$ 100,000 total for PAGA penalties to be allocated as follows: $ 75,000.00 to the LWDA and $25,000.00 to the aggrieved employees.
Plaintiffs are ordered to submit a revised proposed Order consistent with the above within 5 court days.
Plaintiffs are ordered to give notice, including to the LWDA and to file a proof of service.
